By accessing or using SafetyTrack ("the Service"), operated by SafetyTrack ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service.
SafetyTrack is available exclusively to authorised users of participating organisations. Access is provided by your organisation administrator or by SafetyTrack. The Service is not open to the general public, and no public registration is offered.
You must only access businesses, sites and data that you have been explicitly authorised to access. You must not share your login credentials or allow unauthorised individuals to use your account.
Where SafetyTrack is used by an organisation, the organisation is responsible for:
SafetyTrack is a cloud-based health, safety and compliance management platform designed to help authorised business users manage compliance documents, risk assessments, incident recording, audits, inspections, maintenance records, tasks and regulatory reporting. The Service is provided via web browser and mobile application.
SafetyTrack is a management tool, not legal or professional advice.
SafetyTrack assists in organising and tracking compliance activities but does not guarantee regulatory compliance. Reports, records and documents generated by the platform are based entirely on information entered by users. You remain solely responsible for meeting all applicable legal, regulatory and professional obligations. You should obtain independent professional advice where required.
You are responsible for the accuracy, completeness and legality of all information you enter into the platform. Reports, certificates and records are based on the data you and your organisation provide. SafetyTrack does not independently verify the accuracy of information submitted by users.
You and your organisation are responsible for ensuring that all personal data processed using SafetyTrack is handled in accordance with applicable data-protection law, including UK GDPR and the Data Protection Act 2018. This includes ensuring appropriate lawful bases are in place for processing employee and third-party personal data, including any special-category data such as health information.
You agree to use the Service only for lawful business purposes. You must not:
You retain ownership of all data you upload to SafetyTrack ("Customer Data"), including documents, photos, incident records and risk assessments. You grant SafetyTrack a limited licence to process Customer Data solely to provide the Service in accordance with these Terms and the applicable data-processing agreement.
The SafetyTrack platform, including its design, software, features and branding, is owned by SafetyTrack and protected by intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you other than the limited right to use the Service as described herein.
Each party agrees to keep confidential any non-public information received from the other party in connection with the Service. SafetyTrack will not disclose Customer Data to third parties except as required to provide the Service, as instructed by the customer, or as required by law.
We aim to maintain high availability but do not guarantee uninterrupted access to the Service. Planned maintenance will be notified where practicable. We reserve the right to modify, suspend or discontinue features with reasonable notice. SafetyTrack is not liable for losses caused by planned or unplanned unavailability.
On termination of the Service, customers may request an export of their Customer Data before account closure. Administrators should contact SafetyTrack to arrange data export. Following termination, Customer Data will be retained and deleted in accordance with the applicable data-processing agreement and applicable law.
To the maximum extent permitted by law, SafetyTrack shall not be liable for any indirect, incidental, special or consequential damages arising from use of or inability to use the Service, including data loss, business interruption or regulatory penalties. SafetyTrack's total liability shall not exceed the amounts paid by the customer for the Service in the preceding twelve months.
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We may update these Terms periodically. We will provide at least 14 days' notice of material changes via the platform or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
